Texas property insurance claims

Know the law before a contractor promises to “cover” your deductible.

Texas law requires an insured property owner to pay the deductible that applies to a claim. Contractors cannot legally waive, absorb, rebate, credit, or otherwise help a customer avoid paying it.

If your insurance policy requires a deductible, you are responsible for paying it.

What contractors are prohibited from doing

A contractor paid from property-insurance proceeds may not knowingly help the insured avoid the deductible. That includes disguising the waiver through pricing, credits, rebates, or other arrangements.

  • Paying or waiving the deductible
  • Absorbing it into the job price
  • Offering a rebate, credit, or offset
  • Inflating an estimate to hide the deductible
  • Otherwise helping the policyholder avoid payment

Protect yourself

Keep the claim and payment process transparent.

Keep proof of payment

Your insurer may request a canceled check, card statement, receipt, or payment-plan documentation showing that you paid the deductible.

Question “free roof” promises

A contractor offering to erase your deductible may be misrepresenting the repair cost or planning to cut corners on the work.

Choose clear documentation

Use a written scope and estimate, ask questions, and speak with your insurer before agreeing to any unusual payment arrangement.
